Members are entitled to receive selected monthly wines (or such other designated wines as applicable to the particular membership) and additional benefits as provided. The benefits are presented in more detail at recordfamilywines.com. Not all benefits are the same for all members, and some special promotional offers, benefits and communications may be based on a variety of factors. In order to be eligible for benefits, your account must be in good standing and current fees must have been paid. Abuse of club membership may result in termination of your membership and disqualify you from future Club participation. Member benefits are non-transferable. Member discounts and benefits are not valid with other special offers or discounts offered by any of our locations.
While every effort will be made by Record Family Wines, all members acknowledge that the selected featured monthly wines are limited in quantities and may not always be available at the time of shipping or pick-up, particularly in the event that a club member who has selected “pick-up” does not retrieve their wine in the month in which that wine was offered. Record Family Wines cannot guarantee that the wines of the month will be available at a later date. Record Family Wines may substitute another wine for any wine that is no longer available, without any adjustments or refund.
There will be no exchanges allowed for shipped wines, except as set forth in this paragraph. If your wine, at the time of delivery, is received damaged, spoiled or otherwise defective, you may contact us regarding the damage and we may, in our discretion and based on the particular conditions of each such circumstance, send a replacement in exchange, which is your sole and exclusive remedy for damaged or defective product. We will not refund shipping charges, and additional shipping and other charges will apply to deliveries to you that are returned as undeliverable or refused.
All membership fees and associated charges (such as shipping charges, if any) are automatically billed to your credit card. Club benefits are activated immediately following registration. If your membership is a monthly membership with in-store pick-up, fees are charged monthly, on the first day of the month. If you have purchased a gift membership, the fees are charged monthly, on the first day of the month. All wines of the month will be available for pick-up starting on the first Wednesday of the month unless otherwise communicated. All fees charged are non-refundable except as set forth in these Terms.
All memberships are on a month to month basis, and your membership automatically renews each month on the last calendar day of the month preceding the month when the wine is available for pickup. If you wish to cancel your membership, you must let us know by emailing info@recordfamilywines.com at least five (5) days before the renewal date, preceding the month for which your cancellation is to be effective, and any fees already charged for any membership, are non-refundable.
It is your responsibility to inform Record Family Wines of any changes to your membership account and information. Changes to your membership account and information, other than cancellations, can be made by contacting info@recordfamilywines.com. All changes, including cancellations, must be received at least five (5) days prior to any charge or shipment in order to be effective. Fees will be due for any cancellations or changes not submitted on-time
Taxes and other related charges may vary by state and location and may be changed by Record Family Wines from time to time.
If we are ever unable to ship your wine to you due to changes in alcohol and wine related laws, we will offer you the option to change your membership to in-store pick up, and if that is not agreeable, you may cancel your membership and you may receive a refund of any membership costs paid for wine that we were not able to ship to you based on changes to the laws.
All goods, services, and benefits provided by Record Family Wines are only provided and/or shipped to such states in which Record Family Wines is licensed to provide such goods, services, and benefits. Club membership is void where prohibited, and by joining the Club, you represent that your membership and your receipt of any goods, services or other items received through the Club does not violate any laws. You agree to comply with all laws, including laws governing the possession and use of alcoholic beverages. If any product is requested to be provided in or shipped to any state where Record Family Wines is not appropriately licensed, Record Family Wines can refuse such shipment. Wines will be provided or delivered only to persons who are at least 21 years old. In joining the Club, you represent to Record Family Wines that you and the person to whom delivery of any wine will be made are at least 21 years old. When your wine is picked up or delivered, the person receiving the product will be required to show identification proving Club membership and that he or she is at least 21 years old. Record Family Wines has the right to terminate or suspend the Club, or your membership in the Club, at any time and for any reason whatsoever.
In the event of any circumstances outside of the control of Record Family Wines and which prevent, hinder or delay Record Family Wines from performing its obligations, including but not limited to acts of God, earthquake, flood, severe weather conditions, pandemics, viruses, or other natural calamity, strikes, insurrection or acts of terror, governmental action or inaction, including delays or failure to issue permits and authorizations or an inability to obtain supply and materials or means of shipping, Record Family Wines may suspend its obligations for the term of such event or Record Family Wines may elect to cancel the Club or Club membership for the affected members.
Record Family Wines requires certain personal information from you to administer your membership, and you agree that you have freely provided that information. You authorize Record Family Wines to send you marketing communications and special offers as part of your membership benefits.
